These Terms & Conditions (“Terms”) govern all services provided by Zero Driver Limited trading as D.A.D – Dial a Driver (“Company”, “we”, “our”, or “us”). By hiring our service (in person, by phone, or online), visiting our website dialadriver.co.nz, or interacting with our drivers, you (“Customer”, “you”, or “your”) automatically agree to these Terms.

These Terms are designed to maximise the safety of our drivers and customers while providing the strongest possible legal protection for Zero Driver Limited.

1. SERVICE OVERVIEW

D.A.D – Dial a Driver provides designated driver services, where a professional driver operates your vehicle and transports you to your chosen destination.

We are not a taxi, rideshare, shuttle, courier, or passenger service provider.
We only drive your vehicle with your consent.

2. CUSTOMER ELIGIBILITY & LEGAL AUTHORITY

By using our service, you confirm that:

  1. You are at least 18 years old.

  2. You are the legal owner, authorised driver, or lawful leaseholder of the vehicle.

  3. Your vehicle has:

    • A valid Warrant of Fitness (WOF)

    • Current registration

    • Full insurance coverage

    • No mechanical defects

  4. You authorise our driver to operate your vehicle entirely at your own risk.

  5. You accept full responsibility for the vehicle, passengers, and outcome of the transport.

3. DRIVER QUALIFICATIONS

All D.A.D drivers:

  • Are 25+ years old

  • Hold a valid NZ full driver licence

  • Hold a Passenger Endorsement (P Endorsement)

  • Comply with all NZ transport regulations

  • Follow our strict safety and conduct policies

4. DRIVER RIGHT TO REFUSE OR TERMINATE SERVICE

Our driver may refuse or immediately terminate service if:

  • You or your passengers are aggressive, abusive, threatening, or unsafe

  • You or your passengers are unconscious or excessively intoxicated

  • Any person carries weapons or creates danger

  • The vehicle is unsafe, unregistered, unwarranted, or uninsured

  • There is insufficient fuel to complete the ride

  • The environment is unsafe, including unsafe neighbourhoods or locations

  • The customer attempts to drive the vehicle during the service

  • Any form of physical contact with the driver occurs

  • The customer requests illegal or unsafe manoeuvres

  • The driver has reasonable grounds to believe the job compromises safety

The driver’s decision is final.

5. CUSTOMER RESPONSIBILITIES

You must ensure:

  1. Vehicle is roadworthy, legal, clean, safe, and properly maintained.

  2. There is adequate fuel to complete the transport.

  3. All passengers wear seatbelts.

  4. No passenger smokes in the vehicle.

  5. All behaviour remains respectful and non-threatening.

  6. Children have legally required car seats (we do not provide child restraints).

  7. You are dropped off last if multiple passengers are present.

6. SERVICE AREA

We operate predominantly in the Auckland region.
Jobs outside Auckland may be accepted at our discretion and may incur additional travel fees.

7. FEES & CHARGES

7.1 Base Fare

Minimum fare: $70

7.2 Distance & Time

Calculated via Google Traffic API.

7.3 Additional Charges

  • Extra stop: $5 per stop

  • Waiting time after 15-minute grace period: $1.00 per minute

  • Out-of-area travel fee: $3.20 per km (e.g., Pukekohe example)

  • Soiling fee: $150

  • Parking, tolls, towing, breakdown, and emergency costs are the full responsibility of the customer.

7.4 Surge Pricing

A surge of 25%–100% may apply:

  • Peak hours

  • After-hours service (4:00 AM onwards)

  • Sundays

  • High-demand periods

No surge applies to advance bookings.

8. CANCELLATIONS & REFUNDS

  • Cancellations accepted anytime but fees may apply.

  • Refunds processed to original payment method (5–10 business days).

  • If the driver has already been dispatched, a call-out charge may apply.

9. ACCIDENTS, DAMAGE & INSURANCE

🚨 MAXIMUM-LIABILITY PROTECTION ACTIVATED

Customer accepts full liability—even if our driver is at fault.

By using our service, you agree that:

  1. Your vehicle insurance is the primary and only cover.

  2. Zero Driver Limited is not liable under any circumstances for:

    • Vehicle damage

    • Loss

    • Theft

    • Mechanical failure

    • Traffic infringements

    • Accidents of any kind

  3. You pay all insurance excess, regardless of who was at fault.

  4. You waive any claims against Zero Driver Ltd, its drivers, and agents.

  5. You accept that driving any vehicle involves inherent risks.

This clause provides the maximum legal protection available in New Zealand.

10. EMERGENCY PROCEDURES

In case of emergency:

  • Driver may call emergency services

  • Vehicle may be parked safely at the nearest legal location

  • Keys may be returned later or stored securely

  • Customer pays all associated costs (towing, parking, recovery)

11. RELEASE OF LIABILITY & NO LEGAL ACTION CLAUSE 

To the fullest extent permitted by NZ law:

🔒 You release Zero Driver Ltd, its drivers, contractors, employees, and owners from:

  • All liability

  • All claims

  • All demands

  • All costs

  • All damages

  • All lawsuits

  • All disputes

🔒 You agree not to sue or bring any legal action for:

  • Personal injury

  • Vehicle damage

  • Third-party damage

  • Loss of income

  • Emotional distress

  • Any consequence of using our service

🔒 If you initiate legal action, you agree to:

  • Pay all legal fees incurred by Zero Driver Limited

  • Reimburse all costs

  • Fully indemnify the Company and its drivers

This clause is enforceable to the maximum extent allowed under New Zealand law.

12. CUSTOMER INDEMNITY 

You agree to fully indemnify and hold harmless Zero Driver Limited and its drivers from any claims, losses, damages, legal fees, liabilities, and costs arising from:

  • Your actions

  • Your vehicle

  • Your passengers

  • Misrepresentation of vehicle condition

  • Mechanical failure

  • Illegal activity

  • Accidents

  • Damage to property

13. WEBSITE TERMS & COPYRIGHT

All content on dialadriver.co.nz—including branding, images, pricing, software, text, and layouts—is protected by copyright law.

You may not:

  • Copy or reproduce any material

  • Create derivative content

  • Interfere with the booking system

  • Scrape data

  • Use the website for fraudulent activity

14. PRIVACY POLICY SUMMARY

We collect personal information to deliver services.
We do not store credit card details.
We may share your data with:

  • Drivers

  • Law enforcement

  • Debt collectors

15. GOVERNING LAW

These Terms are governed exclusively by the laws of New Zealand.
Any disputes must be filed in the Auckland courts only.

16. SEVERABILITY

If any clause is found invalid, the rest remain enforceable.

17. ENTIRE AGREEMENT

These Terms supersede all previous agreements or communications.
